Welcome to PigmaLab! These Terms of Service ("Terms") govern your access to and use of the PigmaLab web application, website, and any related services (collectively, the "Service"), provided by PigmaLab ("we," "us," or "our"). Please read these Terms carefully before using our Service.

1. Account Registration and Use

1.1. Eligibility: You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

1.2. Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

1.3. Email Verification: We require new users to verify their email address to activate their account. You agree to provide a valid email address and to complete this verification process. We are not responsible for your failure to receive critical notifications if your email address is invalid.

2. User Content and Data

2.1. Your Content: You retain full ownership of all the data, text, files, and other materials you create or upload to the Service, including project details, tasks, and discussion messages ("User Content"). We do not claim any ownership rights to your User Content.

2.2. Our License to Your Content: By using the Service, you grant us a limited, worldwide, non-exclusive license to host, copy, transmit, and display your User Content solely for the purpose of providing and improving the Service. This license ends when you delete your User Content or your account.

2.3. Responsibility: You are solely responsible for your User Content and for complying with all applicable laws, including copyright and data privacy laws. You agree not to upload any content that is unlawful, harmful, or infringes on the rights of others.

3. Use of AI Features

3.1. AI-Powered Assistance: The Service includes features powered by third-party Large Language Models (LLMs) to assist with tasks such as project plan generation and in-task chat. To use these features, you must provide your own API key from a supported third-party AI provider (e.g., OpenAI, Google).

3.2. Data Transmission: When you use an AI feature, the relevant data (such as your chat messages, task context, or project description) will be sent to the third-party AI provider you have configured. Your use of these features is subject to the terms and data privacy policies of that third-party provider.

3.3. No Liability for AI Output: The output from AI features is generated by the LLM and is provided on an "as-is" basis. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You are responsible for reviewing and validating all AI output before relying on it.

4. Acceptable Use Policy

You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to, the following:

• Probing, scanning, or testing the vulnerability of any system or network.
• Breaching or otherwise circumventing any security or authentication measures.
• Sending unsolicited communications, promotions, or spam.
• Using the Service to store or transmit viruses, malware, or other malicious code.
• Infringing on the intellectual property rights of others.

We reserve the right to suspend or terminate your account without notice if you violate this policy.

5. Termination

You are free to stop using our Service at any time. We also reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PIGMALAB DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL PIGMALAB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

7. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision is material, we will provide you with reasonable notice prior to the new terms taking effect. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised Terms.
